This Indenture made this the second day of March in the year of our Lord one thousand eight hundred and thirty seven between Alexander Davenport & Pethenah Davenport his wife of the one part, and David Ambrose of the other part both of the County and State aforesaid, Witnesseth that we the said Alexander Davenport and wife Pethena [sic] Davenport for and in consideration of the sum of twenty five dollars to us in hand paid by the said David Ambrose the receipt wherof we do hereby acknowledge ourselves fully satisfied contented and paid, have granted bargained and sold, and by these presents do grant bargain and sell until David Ambrose a certain piece or parcel of land situated lying and being in the County aforesaid on the west side of Scuppernong River, butted and bounded and begining as follows viz. and known by the name of the ?Jinnet Land which fell to me Pethanah Davenport by the death of Elizabeth Warrington, Begining at the swamp in a cypress stump and little bay tree at the edge of the swamp in the said David Ambroses line, thence north along David Ambroses line three hundred and three poles to an ash, thence west along the said line to Benjamin Arnolds corner so called, thence south along the Benjamin Arnold line to the first station, known by lot number three drawn by me as the heir of my sister Elizabeth Warrington, containing by estimation forty-two acres, be the same more or less, to have and to hold, the aforesaid tract or parcel of land to him the said David Ambrose, his heirs executors and administrators or assigns and I the said Alexander Davenport and wife Pethena Davenport will forever warrant and defend his right and title, interest and demand unto him the said David Ambrose and his heirs free and clear from me and my heirs, executors and administrators or assigns and from the lawful claims or demands of anyother person whatsoever, In witness whereof wehave unto set our hands and fix our seal, this day and date first above written--

Court of Pleas and quarter sessions, Washington County May Term 1837

Then was the within deed of bargain and sale exhibited in open court and the execution thereof duly proved by the oath of Alexander H. Davenport, the subscribing witness thereto, and its being represented to the Court, Parthena [sic] Davenport the feme covert grantor thereof, is so infirm as to be unable to attend court to make her acknowledgment thereof, it was ordered by the Court that the Clerk give a commission to Asalom [sic] Davenport and Ashbery Norman, Esqrs, acting Justices of sd County, as commissioners to take the acknowledgement a prive examination of said Parthena Davenport and make ?return thereof to the next term of this Court.

To Absolom Davenport and Ashberry Norman Esquires greeting. Whereof David Ambrose hath provided a deed of conveyance made to him from Alexander Davenport and Pethana his wife of a certain tract or parcel of land lying and being in the County of Washington, and it being represented to our Court, that Pathena wife of the said Alexander is an inhabitant of Washington County and is so aged or infirm that she cannot travel to our said Court to be privately examined, as to her free consent in executing the said conveyance, know ye that ?? in your prudence and fidelity have appointed you, and do give unto you, full power and authority to take the private examination of the said Pethena wife of the said Alexander ?concertaining her free consent in her executing the said conveyance, and therefore command you, that at such time as you think fit you go to the said Pethena if she cannot conveniently come to you, and privately and apart from her husband, examine her the said Pethena, whether she consented this said conveyance freely and of her own accord, without fear or compulsion of the said Alexander her husband, and examination being plainly wrote on the said deed, or one some paper annexed thereto, and when you shall have so taken, the said examination you are to send the same closed up, under your seals with this writ, to our said to be held for said County at the Court House in Plymouth on the third Monday of August 1837. Be it known that pursuant to a commission issued from the Washington County Court directed to us, we did on the 12 day of August 1837 proceed to take the acknowledgment of Parthena Davenport of her execution of the annext deed from Alexander Davenport & Parthena Davenport to David Ambrose when she acknowledged, signed, sealed the deed aforesaid for the purpose therein named and the said Parthena duly examined apart from her said husband, acknowledged that she executed the same deed truly without any ?force or compulsion of her husband which we do accordingly certify, etc. etc.
